Whenever a motor vehicle is being operated on a roadway or shoulder adjacent thereto during the times spec- ified in Code Section 40-8-20, the driver shall use a distribution of light, or composite beam, directed high enough and of sufficient intensity to reveal persons and vehicles at a safe distance in advance of the vehicle, subject to the following requirements and limitations: (1) Whenever a driver of a vehicle approaches an oncoming vehicle within 500 feet, such driver shall use a distribution of light, or composite beam, so aimed that the glaring rays are not projected into the eyes of the oncoming driver. The lowermost distribution of light, or composite beam, specified in paragraph (2) of Code Section 40-8-30 shall be deemed to avoid glare at all times, regardless of road contour and loading; and (2) Whenever the driver of a vehicle follows another vehicle within 200 feet to the rear, except when engaged in the act of overtaking and passing, such driver shall use a distribution of light permissible under this chap- ter other than the uppermost distribution of light specified in paragraph (1) of Code Section 40-8-30.
(12) A school bus when such vehicle is required to comply with the identification and equipment require- ments set forth in Code Section 40-8-115; (13) A vehicle operated in the course of business by a person licensed or registered as a private detective business or private security business under Chapter 38 of Title 43; (14) A vehicle operated by a neighborhood watch program provided that such vehicle is clearly identified as in operation by such program and such program has been established in accordance with local law enforcement standards for such programs; or (15) The lead vehicle in a funeral procession when such vehicle complies with the requirements of Code Section 40-6-76. (c) Any vehicle owned or leased by the federal government may utilize flashing or revolving amber lights when operating upon highways provided that such vehicle is being operated for an authorized federal purpose. (d) Equipment capable of producing flashing or revolving amber lights shall be mounted upon a vehicle in a manner so as to be visible under normal atmospheric conditions from a distance of 500 feet from the front and rear of the vehicle. (e) Unless authorized by this Code section or Code Section 40-6-6, 40-8-91, or 40-8-92, it shall be unlawful to operate any vehicle with flashing or revolving amber lights on a highway. (f) A violation of this Code section shall be punished as a misdemeanor; provided, however, that a violation of this Code section during the commission of a felony shall be punished as a felony. (g) Nothing in this Code section shall prohibit the use of blinking or flashing parking or brake lights or directional signals on a motor vehicle.
